General conditions of sale

1. DEFINITION AND OBJECT OF THE CONTRACT

1.1 – This contract (“Contract”) is an off-premise contract in accordance with Art. 50 and ff. of Italian Legislative Decree no. 206 dated 6 September 2005 (the “Consumer Code”). The object of this Contract is the sale of goods between DOLCIARIA A. LOISON Srl (owner of the Loison trademark) (“Loison”) and the customer (“Customer”).

The Contract is finalized directly through acceptance of a purchase order issued by the Customer over the Internet, following invitation to make purchases on the website shop.loison.com (the “Website”) and/or through other off-premise methods of sale employed by Loison, on the basis of the procedures described in section 3 below.

1.2. – These general conditions of sale (“General Conditions”) and, in particular, the stipulations of Art. 52 of the Consumer Code, as provided by Loison and presented on the Website, will remain valid and effective until they are modified and/or supplemented by Loison. Any modifications and/or supplements of the General Conditions will be effective beginning on the date that they are communicated to the public and will be applicable to any sales made from that date. The latest updated version of the General Conditions is that available on the Website.

2. PRICES

Sale prices of the products shown on the Website and/or through any other off-premise method of sale employed by Loison include VAT (I.V.A.) and every other tax.

3. PURCHASE AND PAYMENT METHODS

3.1 –Contracts over the telephone will come into effect upon communicating to the Customer (who contacted Loison by telephone and made, at that time, a purchase proposal by providing the agent with the necessary information to register the Customer’s name, the purchase order and the form of payment) that their request has been accepted.

3.2 – For purchase proposal submitted on the Website, the Customer will receive a summary e-mail from Loison communicating that the purchase proposal is being processed and will be considered as accepted, unless Loison communicates otherwise either by e-mail or over the telephone within 12 (twelve) hours and 1 (one) calendar day from the date of receipt of the summary e-mail. Once that period has elapsed, the Contract over the internet will be considered as completed.

3.3 – Orders will be processed within 24 hours of receipt of the purchase order summary e-mail.

3.4 – Payments can be made via credit cards such as VISA or MasterCard or PayPal.

4. DELIVERY OF PRODUCTS – CLAIMS

4.1 – Loison undertakes to deliver the products to the address indicated by the Customer within 4 working days for shipments in Italy and within 7 working days for shipments abroad. However, during peak promotional and holiday periods, such as Black Friday, Christmas and Easter, shipping times may be extended by up to 3 – 5 working days compared to the standard times, unless specific communications are made.

4.2 – The costs to be borne by the Customer are indicated at checkout and during payment. Excluding any other discounts, a discount is applied based on the cart total, as summarized below:

Shipping costs are free for:

  • Orders over €80 for shipments to Italy
  • Orders over €330 for shipments to France
  • Orders over €180 for shipments to all other foreign countries.

For shipments to addresses that the appointed carrier classifies as remote areas or locations with difficult delivery access, based on the destination postcode and according to its own zoning tables, a dedicated shipping fee may be applied in all countries served by the Site. Where applicable, this fee will be calculated and shown separately at checkout, before the order is confirmed and payment is made.

5. PRODUCT AVAILABILITY

Loison accepts the Customer’s orders within the limits of the quantity of ordered products on hand in the warehouse. Therefore, the acceptance of the Customer’s purchase order by Loison is subject to warehouse availability of these products. Loison will make every effort to promptly inform the Customer of any unexpected shortages of product stocks due to high demand or other reasons.

6. WARRANTIES AND ASSISTANCE

Rules and regulations on warranties and assistance regarding the sale of consumer goods apply to Loison products purchased by the Customer.

7. CUSTOMER’S OBLIGATIONS

The Customer assures and declares: (I) to be a consumer in accordance with Art. 3 of the Consumer Code; (II) to be of legal age; (III) that the information provided by the same to execute the Contract is true and accurate.

8. RIGHT OF WITHDRAWAL

8.1 – The Customer is entitled to withdraw from the contract, without penalty and without giving any reason, within 14 days from the day on which the Customer, or a third party other than the carrier designated by the Customer, takes physical possession of the products, except in the cases excluded by applicable law as set out in Art. 8.2 below. Where a single order is delivered in multiple separate shipments or parcels, the 14-day period runs from the day on which the Customer, or the third party designated by the Customer, receives the last parcel.

For contracts concluded through the Website, the Customer may exercise the right of withdrawal via the dedicated digital withdrawal function, pursuant to Art. 11a of Directive 2011/83/EU, as amended by Directive (EU) 2023/2673, clearly labelled with the words “Withdraw from the contract here” or with another equivalent and unambiguous wording.

The online withdrawal function is continuously available throughout the entire period during which the right of withdrawal may be exercised and is accessible:

  • from the “My account” section of the Website;
  • via a dedicated link in the order confirmation email summary;
  • via a dedicated link in the Website footer.

The function allows the Customer to complete and submit the withdrawal declaration online, by providing or confirming their name, the information required to identify the contract or order from which they wish to withdraw, and the email address or other electronic means through which they wish to receive confirmation of the withdrawal.

Once the online withdrawal declaration has been completed, the Customer must confirm the submission via a second step, labelled with the words “confirm withdrawal” or with another equivalent and unambiguous wording.

Upon activation of the confirmation function, Loison will send the Customer, without undue delay, an acknowledgement of receipt of the withdrawal by email, including the content of the withdrawal declaration and the date and time of its submission.

As an alternative to the digital function, the Customer may exercise the right of withdrawal by means of an unambiguous written communication sent in reply to the order confirmation email, to [email protected].

8.2 – The Customer wishing to exercise the right of withdrawal must return the products to the address indicated on the invoice, following the instructions contained therein, within 14 days of communicating their decision to withdraw from the contract. Pursuant to Art. 16 of Directive 2011/83/EU, the following are excluded from the right of withdrawal:

  • products made to measure or clearly personalised, or which by their very nature cannot be returned or are liable to deteriorate or expire rapidly (e.g. food products);
  • sealed products which are not suitable for return for reasons of hygiene or health protection, where the seal has been removed after delivery.

8.3 – The costs of returning the products shall be borne by the Customer. Loison will refund, within 14 days of the date on which the returned products are received by Loison, or of the date on which the Customer provides proof of having shipped them, whichever is earlier: (i) the full price paid by the Customer, where the product is returned complete with all its parts and functions; or (ii) the portion of the price equivalent to the product actually returned, where the Customer has used the product in an appreciable manner and/or in a way that significantly reduces its value.

8.4 – The refund by Loison to the Customer will be made using the same payment method with which the Customer originally settled the order amount.

9. APPLICABLE LAW

This Contract shall be governed by Italian laws. The Court of Vicenza, Italy, will be competent for any dispute arising from the application, execution, interpretation and breach of this Contract.
